1. Relationship to the Terms of Service
This page restates the disclaimers and liability limits that are part of the Terms of Service. If there is any difference, the Terms of Service control. Nothing here removes a mandatory right you have under Dutch consumer law.
2. No professional advice
Chernion and its output do not provide legal, medical, financial, tax, accounting, safety, or other professional advice, and using the service does not create any professional relationship. Get advice from a qualified professional before making a decision that needs one.
3. Artificial intelligence output
Output is generated by a statistical model and can be wrong, incomplete, outdated, biased, or offensive, and can state false information as if it were true. We do not review output before you receive it and do not warrant that it is accurate, fit for any purpose, original, or free of third party rights. You are responsible for checking output before you rely on it and for any decision or action you base on it.
4. Service provided as is
To the maximum extent permitted by law, the service is provided as is and as available, without warranty of any kind. We do not promise that the service will be uninterrupted, error free, secure, or available at any particular time, and the service depends on upstream providers and infrastructure we do not control.
5. Third party providers and content
The models are owned and run by upstream providers. We are not responsible for their acts, omissions, downtime, pricing, model behaviour, or policy decisions, and their terms apply to the models you use. We are not responsible for content you generate or for how you use it.
6. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss, or for loss of profit, revenue, data, goodwill, or business. To the maximum extent permitted by law, our total liability arising from or related to the service in any twelve month period is limited to the greater of the amount you paid us for the service in the three months before the event giving rise to the claim, or 50 US dollars.
7. Your mandatory rights
Nothing in this page excludes or limits liability that cannot be excluded or limited by law, including liability for intent or deliberate recklessness, for death or personal injury caused by our negligence, or under mandatory Dutch consumer protection law. Where you are a consumer, your statutory rights are not affected, and the limits above apply only to the extent the law allows.
